Why shouldn't these commercial video game charaters aren't copyrightable like all the others? They are quite simple (like most 8 bit games) but clearly copyrighted (the ghosts even have names) and the ghosts have no simple shape like the Pac Man pie. The game, screenshot or parts of it and chararcters are copyrighted. And all derivatives of it can't be free. I don't think they are copyrightable. They are clearly covered by trademark, but the simplistic design of the original arcade game characters isn't complicated enough for a copyright. Either way, this isn't a copy, so the copyright doesn't matter. It is a cookie based on the design that varies from the original design heavily (though still clearly infringing on trademark, which isn't an issue here). Compare to File:Pacman Guggenheim.jpg. Copyright is the right to copy, right? It refers to the original work and derivative works. This is worlds away from the handful of pixels that comprises the original. Clearly this is the trademarked character, but it is not a copy of the copyrighted work.
