Reply from orion_2012 Please delete your allegation immediately. This is an image I took of a trophy that MY team won, on a team I provide media for and within a league that I provide media for. I am the copyright holder of this image and just because YOU may not understand an aspect about the copyright of this image does not mean that I as the copyright holder am required to explain that process to you.

Artistic craftsmanship

"If a work is not a sculpture, it may still qualify for copyright protection as a work of artistic craftsmanship. The types of product that may fall into this category include "handicrafted jewellery tiles, pots, stained-glass windows, wrought-iron gates, hand-knitted jumpers, and crocheted doilies" (Bentley and Sherman summarising the case law in Intellectual Property Law (Second Edition) p74)."

"Unlike most types of copyright works, the courts must adjudge a product as "artistic" before awarding protection under this heading."

"In the most influential case on the question, Henscher v Restawile Upholstery, a prototype of a chair was found not to be artistic, and was therefore unworthy of protection. However, different judges have different views about what is or is not artistic, and the cases following Henscher are not always helpful."

So the onus is upon you to determine whether a sports trophy that belongs to a league that I provide media for would be classified under "Artistic craftsmanship" and furthermore a court would adjudge this sports trophy "artistic" (which is required before awarding any separate protection). I released this image, that I took myself, into the public domain. I'm confused. Are you saying that the fountain has somehow been copyrighted? I'd like to see that.Tomticker5 (talk) 21:06, 9 September 2015 (UTC)[reply]
Yes, under the copyright law of the United States, all artistic works automatically have a copyright, and derivative works here at Wikipedia need a source and license for the original work as well as for the photograph of them. (The United States also does not have freedom of panorama for artistic works.) In this case, if the fountain had not been modified from its original 1895 configuration, the license tag would have been {{PD-1923}}. Since it has been redesigned, I think it likely that the tag would have to be {{non-free 3D art}}. That doesn't mean the item would necessarily have to be deleted, just that we would have to satisfy the provisions of WP:NFCC to keep a photo of the fountain.   • Incomplete/unverifiable source information. The only source given is the National Park Service, which didn't even exist at the time this photo was taken (1909). Did a search of the Library of Congress and had Google do an image search - all of them pointed to this page as the source.     • Over the past ten years, the USGS has updated their websites as well as the aerial photo imagery; thus, I have no way to prove that something that was uploaded a decade ago was valid at that time. The current USGS site has a different aerial photo on the current iteration of the map from an updated photo set. The current photo could be used, but it too will become outdated and future changes to the USGS website will render that one impossible to validate as well.
Due to lack of access to a time machine, there is nothing I can offer a proof. Do as you will with the existing photo.
