Concerning the scans of the fotographs of the paintings in this category the Federal Court of Justice of Germany has held on December, 20th, 2018 in a lawsuit by the Reiss Engelhorn Museum against the uploader, that the upload infringes the photographers right of publication according to § 97 Abs. 1 Satz 1 UrhG, § 72 Abs. 1 UrhG, § 19a UrhG. As the Wikimedia Foundation is convinced to be right, they will appeal against the judgment. The Reiss-Engelhorn Museums could also proceed against other re-users of this picture. Therefore, caution is required when using this picture outside of Commons.
