Please note the source link provided (c-and-e-museum), crediting the image to the Forces Digital Image Centre. This is not a private photograph taken by a service member - The copyright holder is a public Canadian government organisation. The CAF Digital Image Centre's About Us furthermore cites: "We provide: rapid professional quality imagery for public use from wherever the CAF operates". Canadian government photos are not automatically Public Domain - Crown Copyright has a 50 year term, for details see {{PD-Canada-Crown}}. All media on Wikimedia Commons must be either freely-licensed or public domain. Consigned (talk) 07:46, 17 September 2024 (UTC)[reply]
As previously mentioned, the copyright holder themself released the photo for public use.

I don't see anywhere there about a free license, and the footer of the website links to https://www.canada.ca/en/department-national-defence/corporate/intellectual-property/crown-copyright.html, which covers Crown Copyright which I described above. I have previously quoted the section of the link that I provided (http://www.combatcamera.forces.gc.ca/site/combat-camera-eng.asp), which does name the image being free for public use, however I will point it out once again. In the About Us text, this quote can be found in the "We Provide" section and reads: "We provide: rapid professional quality imagery for public use from wherever the CAF operates".
The link you have provided in your response is not connected to the Canadian Forces Digital Image Centre or Combat Camera other than both being linked on the Canadian government website. However, even in the link you provided it still clearly states that the use of this image would fall under "exemptions", where it does not require copyright.

the reproduction is used for personal or public non-commercial use or for cost-recovery use".

"Provided for public use" is not a legal statement, the copyright terms for this site are linked under "Terms and conditions" at the bottom which I linked to above. And no, Wikimedia Commons does not allow photos which only allow non-commercial re-use. Please read the licensing policy at COM:L. Consigned (talk) 18:27, 20 September 2024 (UTC)[reply]
