en:Jimmy Murphy (cartoonist) says he was born in 1891. On this picture he looks older than 30, so this is a post-1923 copyrighted picture Teofilo (talk) 13:19, 9 November 2008 (UTC)[reply]

  • Keep - It might be a post 1923 image but that is quite irrelevant since it is not tagged as a public domain image. I e-mailed the uploader and he stated he holds the copyright to this image (and more images on his flickr page) and therefore can release it under a free content license. If he holds the copyright, he should hold the negative and be able to make a much better quality photo than this. He should also be able to tell us the name of the photographer and the year the photo was taken. Teofilo (talk) 00:41, 10 November 2008 (UTC)[reply]
So from an issue that the image is not PD, which was never implied in the first place, it goes to this. Why should he be able to tell us that? He states that he is the copyright holder and so far I (and Commons) have no reason to not believe that. There are about 200 images of Alan Light (the copyright holder) on Commons. I never asked. I just asked him to confirm, to be sure, that he was the copyright holder of the images, which he stated he was. As said before, I have no reason of not believing that. Garion96 (talk) 14:45, 10 November 2008 (UTC)[reply]
When I see an old black and white photograph scan on Flickr, I usually suspect that the Flickr uploader is not the original photographer, nor a copyright holder. I don't know if this case requires a confirmation through Commons:OTRS. I don't know if OTRS members have a policy of asking for evidence that copyright ownership was transfered, when the uploader is not the photographer himself. I will ask on the Village pump.   • Yes, but also look at the context. Just flickr is a no, but a trusted uploader to flickr of which we have hundreds of images on commons... Either way, an e-mail confirming (c) is send, OTRS has a long queue so it might take a while before it's handled. Garion96 (talk) 13:15, 23 November 2008 (UTC)[reply]
