All of these images are of murals (not street art) that were created by known living artists and/or contain otherwise copyrighted characters and there's no FOP in the United Kingdom for 2D graphic works. So these images should be deleted as COPYVIO unless someone can provide evidence to the contrary.

Constru-centro previously nominated these files for deletion here, here, here, here, and here, resulting in them all being kept based on the assumption that CC licenses are irrevocable. But I don't think they wanted to revoke their licenses; rather, they wanted to say that they didn't own the copyright of the files in the first place.

Prospectprospekt (talk) 03:48, 18 July 2024 (UTC)[reply]

Comment Interesting, there are zero reverse search results for all photos on TinEye or Google Lens prior to the Commons upload dates, so I would be curious where the photos originated if they are not actually 'Own work'. It is very possible these are copyvios, I just cannot find any evidence to suggest so. Also possible the uploader regrets choosing a CC license and wants to have the photos taken down as established. They are of good quality, so either is possible. PascalHD (talk) 22:21, 2 August 2024 (UTC)[reply]
These are obviously professional photos (in particular the one from the 1993 Dangerous Tour and the one of Kinnie Gibson, taken from the stage!), probably the works of Michael Jackson's then official photographer, Mr. Sam Emerson.[1]http://www.redboxphoto.biz/albums/music/

Overall 2/3 of the photo features not the Kaunas Carillon building, but other things (e.g. path, sky, clouds, trees, etc.), so possibly it can be kept even though there is no FoP in Lithuania because the carillon is just located in the centre of the photo, but it do not occupy more than 50% of the photo resolution (I think it is 25-30%). In Commons we keep photos of buildings even of countries where there is no FoP if the copyrighted buildings do not occupy the majority of the photos' content. -- Pofka (talk) 21:16, 18 July 2024 (UTC)[reply]

AI-upscaled image where the source image at File:Yvonne Chollet (1897-1945), member of the French Resistance, c. 1940.jpg was deleted in April 2023 for lacking a valid licence. No other source is specified. Belbury (talk) 11:19, 18 July 2024 (UTC)[reply]

Hello, @Belbury: , Perhaps restore and license the original photograph {{PD-EU-no author disclosure}}. Since it's an identity photograph taken in 1940, whose author remains unknown. The source shows this is a 1978 photo by Johnny Bitang for the Philippine newspaper Bulletin Today. There is no evidence for the stated CC0 license anywhere, and the photo could not be public domain in the Philippines, and probably not the U.S. We would need evidence that the photographer or copyright owner licensed the image. Carl Lindberg (talk) 13:40, 18 July 2024 (UTC)[reply]

No evidence at source for stated license. Source is a listing for selling a copy of a postcard -- https://aucview.aucfan.com/yahoo/c1100968817/ -- so they would have no rights to license it anyways. It appears to be a 1966 Japanese postcard, which may qualify for {{PD-Japan}}. However, it would have been under copyright on the URAA date, so unless this was simultaneously published (within 30 days) in the U.S., it would be under U.S. copyright until 2062. Carl Lindberg (talk) 13:48, 18 July 2024 (UTC)[reply]

The source is http://www.wakanatsu.com/photo/ferryakebono.html . The uploader is claiming they took the photo ("own work"); this seems unlikely. However even if true, it was published on the internet before the upload here, so we would need to follow the COM:VRT procedure to get emailed confirmation of the license from the copyright holder. Sculpture by Georgian artist Zourab Tsereteli (b. 1934) installed in France where there is no freedom of panorama.

Günther Frager (talk) 17:15, 18 July 2024 (UTC)[reply]

Not stated in the source that this (AI upscaled?) image of a person who died in 1974 and wasn't identified until 2022 was "published in the United States between 1929 and 1963". Certainly appears to have been taken before 1963, but it may not have been published publicly until 2022. en:File:RuthMarieTerry.webp considers the image to be copyrighted with 31 October 2022 as the date of publication. Belbury (talk) 18:27, 18 July 2024 (UTC)[reply]

  •  Keep United States case law has ruled that an image is "made public", published in USCO legal terms, when it leaves the custody of the photographer. It does not mean solely reproduced in a newspaper or magazine, even though that is one way an image can be made public. See: Commons:Deletion requests/File:Minerva Kohlhepp Teichert 1908.jpg for a discussion of the relevant case law. It is also not AI upscaled, it is just a larger image, with no increase in apparent resolution or smoothing of grain. --RAN (talk) 18:53, 18 July 2024 (UTC)[reply]
The Teichert discussion seems to say that if a photo was taken by a family member, it wouldn't be considered published. Do we know the provenance of this photo? Are we assuming from the aesthetic that she was sitting for a professional photographer with the possible view that its sale "probably constituted general publication"? The source web page only says Courtesy of the FBI.
I wondered if the {{PD-algorithm}} template meant that you'd used AI to upscale it from the first, smaller file version. Belbury (talk) 09:01, 19 July 2024 (UTC)[reply]
  • I removed algorithm, I must have clicked the new tick box by accident when clicking creator=unknown. Stylistically it appears to be a commercial photograph circa 1955 to 1960 when this style was popular. The style was where the shoulders fade away. --RAN (talk) 18:04, 20 July 2024 (UTC)[reply]

Photos by Giovanni Coruzzi sourced from Bridgeman Images. The files have {{PD-Italy}}, but it is incorrect. Although the photographer name is Italian, the country of origin is France. These photos where taken between 1967 and 1976 in Paris (see description or source link). Several articles from the French newspaper Le Figaro credits him under the French image agencies AGIP/Rue des Archives [3] [4] and Leemage [5] [6]. Notice that Bridge Image acquired both porfolios [7][8]. The copyright protection in France is 70 years pma and therefore they are still protected in its country of origin.

 Keep PD-Italy concerns all Italian photographers. Groupir ! (talk) 22:46, 18 July 2024 (UTC)[reply]
It doesn't matter, COM:L requires works to be in the public domain in the country of origin, and that is not determined by the nationality of the author. Also, people with Italian names are not necessarily Italian. Chiara Mastroianni is the perfect example of a French national with an Italian name. Günther Frager (talk) 23:42, 18 July 2024 (UTC)[reply]
Country of origin is both France and Italy and the rule of the shorter term placed these photos under public domain in the 90s. - Groupir ! (talk) 04:02, 19 July 2024 (UTC)[reply]
If you claim Italy is the country of origin, please provide the evidence these photos where first published in Italy. It would be also good you to read a bit of history before assigning nationality based on names, especially when referring to the extensive Italian diaspora.
