Derivative works of copyrighted things. COM:TOYS mostly but movie posters and COM:SCREENSHOTs too.

I really don't understand what is the issue with File:Star Wars (cropped).jpg and File:Super Mario Bros (cropped).jpg. Please explain why these aren't allowed but all the rest of the video console pictures and Star Wars cosplay figures are allowed on Wikicommons.
Also, the photos File:The Fast & The Furious banner.jpg and File:The Fast & The Furious Car Show (2561914172).jpg aren't screenshots, so why were they nominated for deletion?
Also, the image File:A Corny Concerto (1) (cropped).png is a derivative image (crop) of a public domain short "A Corny Concerto" (1943), so why was it nominated for deletion?
Also, please explain why photos of statues like File:Batman, Superman & Wonder Woman statues (19032936743).jpg aren't allowed. ויקיג'אנקי (talk) 10:35, 28 August 2018 (UTC)[reply]

Ok, first I'm not at my computer 24 hours a day. I will get to responding to things when I am. I have a day job outside of volunteer work here. Now to go through all your points one at a time:
  • The stars wars image was directly cropped to focus on the copyrighted character. The license to both Darth Vader and the Stormtrooper is owned by Disney and this is a gray area per COM:COSPLAY. The original wasn't directly focused on the characters, your crop caused the problem.
  • The Super Mario picture is 100% a derivative work of copyright material owned by Nintendo. Nintendo has a history of aggressively going after anyone who violates their copyright. What other video game console pictures are you talking about? Is the video game under a free license? Or are you talking about an image locally uploaded to one of the other projects that allow fair use?
  • The two The Fast & The Furious banners were nominated by mistake and have been removed from this DR. My apologies.
  • I'm looking into the Corney Concerto one now. I highly doubt the copyright was not renewed on those things. Bugs Bunny especially causes a lot of concern.
  • The Batman, Superman, and Wonder Woman statues are COM:TOYS and again, are copyrighted characters owned by Marvel.
  • I've nominated the other Optimus Prime image for deletion as well. Thank you for pointing it out.
  • Finally, Madame Tussauds. While it is true that the London branch enjoys a large amount of freedom of panorama due to the UK's broad FOP rules there is a problem when the work is already a derivative of something else. The wax figures of people are different from the figures of copyrighted cartoon and movie characters. You cannot copyright a person, you can copyright a character. So the images of characters are actually derivative works of derivative works of things still in copyright (a double derivative if you will). That is what the problem here is. These companies aggressively protect their property going so far as to send cease and desist letters to fan made things that only tangentially touch upon their copyrighted property. No one would be safely able to commercial sell images of File:Star Wars (cropped).jpg. Disney would have our heads. And for that reason it can't be here.

@ User:Majora So if you are against cosplay photos that focus solely on Darth Vader or/and Stormtroopers, why don't you suggest deleting all the pictures in Category:Darth_Vader and Category:Stormtroopers? Why only this one? -- ויקיג'אנקי (talk) 10:26, 29 August 2018 (UTC)[reply]
